Final Order Entered: 1. No retail electric customer is authorized to participate directly or indirectly in any PJM wholesale market, including but not limited to DR programs and EER programs, except under a tariff or special contract on file with the Commission. 2. Every retail electric supplier has the authority under 807 KAR 5:006, Section 15, to terminate electric service to a retail electric customer when the customer is not in compliance with KRS Chapter 278, the regulations promulgated under 807 KAR Chapter 5, or the retail electric suppliers' tariffed rules. 3. EKPC's motion to withdraw from consideration at this time the issue of whether PJM is subject to the Commission for purposes of enforcing the Orders entered in cases that PJM was a party is granted without prejudice. 4. Six months from the date of this Order, EKPC, Kentucky Power, and Duke Kentucky shall individually or jointly file a status report describing the actions taken by PJM to comply with the commitments and provisions of our prior Orders approving the transfer of functional control of transmission assets to PJM. 5. Any documents filed pursuant to ordering paragraph No. 4 of this order shall reference the number of this case and shall be retained in the utility's general correspondence file.
