Order Entered: 1. JPEC shall submit to the Commission, within 20 days of the date of this Order, a written response to the allegations contained in the Report and the alleged violation of 807 KAR 5:006, Section 27, as set forth in the findings above. 2. JPEC shall additionally address its efforts to ensure sufficient oversight and contractual obligations are in place to confirm contractors remain aware of and routinely adhere to applicable construction standards and safety rules contained in the NESC, including those specifically cited in the Report. JPEC shall explain how its on-site monitoring of contractor performed work includes reviewing the specific tasks being performed and safety precautions in place, especially when work is being performed in the vicinity of energized lines. JPEC shall provide the Commission with specific evidence of its efforts to ensure that contractors performing utility-related work comply with the appropriate provisions of the Commission's rules and regulations, including the NESC. 3. JPEC shall appear on March 17, 2015, at 10:00 a.m. Eastern Daylight Time, in Hearing Room 1 of the Commission's offices at 211 Sower Boulevard in Frankfort, Kentucky, for the purpose of presenting evidence concerning the alleged violations of KRS 278.042, the most recent edition the NESC, and 807 KAR 5:006, Section 27, and showing cause why it should not be subject to the penalties prescribed in KRS 278.990(1)for these alleged violations.
