Final Order Entered: (1) Butler County is granted a CPCN for the proposed construction project. (2) Butler County's proposed plan of financing is approved. (3) Butler County is authorized to issue to RD a promissory note in the amount of $437,000 which matures over a 40-year period at an interest rate not exceeding 2.75 percent per annum. (4)The proceeds from the proposed promissory note shall be used only for the purposes specified in Butler County's application. (5) Butler County shall obtain approval from the Commission prior to performing any additional construction not expressly authorized by this Order. (6)Notwithstanding ordering paragraph 5, if surplus funds remain after the approved construction has been completed, Butler County may use such surplus to construct additional plant facilities if RD approves of the use and the additional construction will not result in a change in Butler County's rates for service. Butler County shall provide written notice of this additional construction in accordance with 807 KAR 5:069, Section 4. (7) Butler County shall file with the Commission documentation of the total costs of this project, including the cost of construction and all other capitalized costs, (e.g., engineering, legal, and administrative) within 60 days of date construction is substantially completed. Construction cost shall be classified into appropriate plant accounts in accordance with Uniform System of Accounts for water utilities prescribed by the Commission.

Order Entered: (1) The two federal identification numbers contained with Butler County's original application meet the criteria for confidential treatment and are exempted from public disclosure pursuant to KRS 61.878(1) and 807 KAR 5:001, Section 13. (2)The two federal identification numbers shall be redacted from the public record and not made available for public inspection for an indefinite period of time. (3)The documents that revealed the two federal identification numbers shall be placed in a confidential file. (4) Use of the materials in question in any Commission proceeding shall comply with 807 KAR 5:001, Section 13(9). (5) If a non-party to this proceeding requests to inspect materials granted confidential treatment by this Order, Butler County shall have 20 days from receipt of written notice of the request to demonstrate that the materials still fall within the exclusions from disclosure requirements established in KRS 61.878. If Butler County is unable to make such demonstration, the requested materials shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. (6) The Commission shall not make the requested materials available for inspection for 20 days following an Order finding the materials no longer qualify for confidential treatment in order to allow Butler County to seek a remedy afforded by law.
