NEBO WD Revised Tariff

Final Order Entered: (1) Nebo District's request to substitute its proposed tariff sheet of August 6, 2012 for that submitted on April 30, 2012 is granted. (2) Those portions of the Commission's Order of July 23, 2012 that required Nebo District to submit certain information to the Commission are vacated. (3) Effective October 1, 2012, Nebo is authorized to require a cash deposit of $75 to secure payment of customer bills from any person applying for service after the date of this Order and any customer who fails to maintain a satisfactory payment record. (4) Within 20 days of the date of this Order, Nebo District shall file a revised tariff sheet setting forth the case deposit approved in this Order.

Order Entered: (1) This proceeding is hereby established to determine the reasonableness of Nebo Water District's proposed tariff revisions. (2) Nebo Water District's proposed tariff revisions are suspended from August 1, 2012 up to and including December 31, 2012. (3) Nebo Water District shall file with the Commission within 21 days of the date of this Order an original and eight copies of the information listed in the Appendix to this Order. Nebo Water District's response shall comply with the provisions of ordering paragraph 4 of this Order. (4) a. All responses to requests for information shall be appropriately bound, tabbed and indexed and include name of witness responsible for responding with copies to all parties and eight copies to Commission. b. Each response shall be under oath or be accompanied by a signed certification of preparer or person supervising preparation of the response that the response is true and accurate to the best of that person’s knowledge, information, and belief formed after a reasonable inquiry. c. party shall make timely amendment to any prior response if it obtains information that indicates that the response was incorrect when made or, though correct when made, is now incorrect in any material respect. d. For any request to which a party fails or refuses to furnish all or part of the requested information, that party shall provide a written explanation of the specific grounds for its failure to completely and precisely respond.
