Order Entered: EKPC is authorized to obtain a trust indenture in accordance with the parameters described in its Application. 2. EKPC shall file with the Commission, within 10 days of its selection, a written notice of its selection of the trustee which will administer the trust indenture. 3. EKPC shall file with the Commission, within 10 days of its execution, the trust indenture it obtains in accordance with the parameters set out in its Application. 4. Any documents filed pursuant to ordering paragraphs 2 and 3 of this Order shall reference the number of this case and shall be retained in the utility’s general correspondence file. Nothing contained herein shall be construed as a finding of value for any purpose or as a warranty on the part of the Commonwealth of Kentucky or any agency thereof as to the securities authorized herein.

Commission Staff's First Request for Information to East Kentucky Power Cooperative, Inc.

Order Entered: I. The procedural schedule set forth in the appendix to this Order shall be followed in this proceeding. 2. Responses to requests for information shall be appropriately bound. 3. Each response shall be answered under oath. 4. Any party shall make timely amendment to any prior response. 5. For any request to which a party fails or refuses to furnish all or part of the requested information, that party shall provide a written explanation. 6. Any party requesting intervention status in this proceeding shall accept the procedural schedule set forth in the appendix to this Order. 7. Any party filing testimony shall file an original and seven copies. 8. EKPC shall give notice of any public hearing in accordance with the provisions set forth in 807 KAR 5:Oll , Section 8(5). At the time publication is requested EKPC shall forward a duplicate of the notice and request to the Commission. 9. At any public hearing in this matter, neither opening statements nor summarization of direct testimony shall be permitted. 10. . Any objections or motions relating to discovery or procedural dates shall be filed upon four business days’ notice or the filing party shall explain, in writing, why such notice was not possible. 11. Motions for extensions of time with respect to the schedule herein shall be made in writing and will be granted only upon a showing of good cause. 12. Nothing contained herein shall prevent the Commission from entering further Orders in this matter.
