Order Entered: 1. The Joint Stipulation of Facts and Settlement Agreement is adopted and approved in its entirety as a complete resolution of all issues in this case. 2. LG&E is assessed a penalty of $22,500.00. 3. LG&E shall pay $11,250.00 of the $22,500.00 civil penalty within 30 days of the date of this Order by cashier’s check or money order payable to the Kentucky State Treasurer . 4. The remaining $11,250.00 of the civil penalty is suspended on the condition that LG&E abide by the terms contained in the Settlement Agreement and provide all required documentation (as described in paragraphs 4, 5 and 6 of the Settlement Agreement) within the time allotted. 5. Within 30 days of the date of this Order, LG&E shall provide to the Commission documentation that training on proper grounding procedures has been given to LG&E employees during safety meetings. 6. Within 30 days of the date of this Order, LG&E shall provide to the Commission documentation that proper grounding procedures were addressed with its contractors at its contractor safety meeting on May 11, 2012. 7. Within 30 days of the date of this Order, LG&E shall provide documentation that all known GIS Mapping deficiencies on its URD system as of April 30, 2012 have been corrected. 8. LG&E will inspect its URD systems during its normal two-year inspection process. 9. The hearing scheduled for 9/25/12 is cancelled. 10. Upon payment of the $11,250.00 civil penalty, this case shall be closed.

LG&E'S PETITION FOR CONFIDENTIAL PROTECTION

Order Entered: (1) LG&E shall submit to the Commission within 20 days of the date of this Order, a written response to the allegations contained in the Report. (2) LG&E shall appear on September 25, 2012 at 10:00 a.m. in Hearing Room 1 of the Commission's offices for the purpose of presenting evidence concerning the alleged violations of KRS 278.042. (3) At the scheduled hearing in this matter, LG&E shall also present evidence on the adequacy, safety and reasonableness of its practices related to the construction, installation, and repair of electric facilities and whether such practices require revision as related to this incident. (4) The September 25, 2012 hearing shall be recorded by videotape only. (5) The Report in Appendix A is made a part of the record in this case. (6) Any requests for an informal conference with Commission Staff shall be set forth in writing and filed with the Commission within 20 days of the date of this Order.
