Order Entered: (1) Except where they contradict or conflict with the findings contained in this Order, the findings contained in Commission Staffs report are adopted and incorporated by reference into this Order as if fully set out herein. (2) Ledbetter District’s proposed rates are denied. (3) The rates set forth in the Appendix to this Order are approved for sewer service that Ledbetter District renders on and after the date of this Order. (4) Within 20 days of the date of this Order, Ledbetter District shall file revised tariff sheets with the Commission setting forth the rates approved in this Order.

Order Entered: (1) No later than May 7, 2012, Commission Staff shall file with the Commission and serve upon all parties of record a report containing its findings and recommendations on Ledbetter Sewer District’s application. (2) The parties shall file with the Commission their written comments on and any objections to the findings and recommendations contained in the Commission Staff Report no later than May 21, 2012, or 14 days after the date of the filing of the Commission Staff Report, whichever occurs earlier. Any party may file with such submission any additional evidence for the Commission’s consideration. (3) A party’s failure to file written objections to a finding or recommendation contained in the Staff Report by May 21, 2012, or 14 days after the date of the filing of the Commission Staff Report, whichever occurs earlier, shall be deemed as agreement with that finding or recommendation. (4) No later than May 21, 2012, or 14 days after the date of the filing of the Commission Staff Report, whichever occurs earlier, each party shall notify the Commission in writing whether this matter may be submitted for decision based upon the existing record and without hearing. (5) All provisions of the Commission’s Order of March 2, 2012 that conflict with the provisions of this Order are vacated. All remaining provisions shall remain in full force and effect.

Order Entered: 1. This proceeding is established to review the reasonableness of Ledbetter District‘s proposed rates.‘ 2. No later than April 30, 2012, Commission Staff shall file with the Commission and serve upon all parties a written report containing its findings and recommendations. 3. The parties shall file with the Commission their written comments no later than May 15, 2012. 4. A party’s failure to file written objections May 15, 2012, shall be deemed as agreement with that finding or recommendation. 5. No later than May 15, 2012, each party shall notify the Commission whether this matter may be submitted for decision based upon the existing record without hearing. 6. Unless all parties request that this matter be submitted for decision upon the existing record, an informal conference shall be held in this matter on May 31, 2012. 7. Unless all parties request that this matter be submitted for decision upon the existing record, a formal hearing in this matter shall be held in the Commission’s offices. 8. Each party shall file with the Commission, no later than June 8, 2012, a list of the persons it intends to call as witnesses. 9. Ledbetter District shall publish notice of the scheduled hearing, no more than 21 days and no less than seven days before the day of the scheduled hearing. 10. The record on the formal hearing in this matter shall be by videotape. 11. Commission Staff shall make a written exhibit list.
