Order Entered: (1) A formal hearing held on November 28, 2011 beginning at 10:00 a.m. in Hearing Room 1 of the Commission's offices. (2) Preliminary motions will be heard at the start of the hearing and prior to the parties' opening statements. (3) Each party may make an opening statement of not more than five minutes in length. (4) James Wood is designated as hearing examiner to conduct the scheduled hearing and to perform all actions necessary to ensure the orderly conduct of this hearing. (5) Pursuant to KRS 278.360, the record of the formal hearing shall be by videotape. (6) Commission Staff shall make a written exhibit list and file list with the commission. (7) On or before November 21, 2011, each party shall file with the Commission a list of the witnesses it expects to call at the formal hearing and a summary of their expected testimony. (8) On or before November 4, 2011, a party may serve requests for information upon any opposing party. (9) Service of any document shall be made in accordance with 807 KAR 5:001, Section 3(7). (10) Any party filing a document with the Commission shall serve such document upon all other parties. (11) Any document a party serves upon the other parties shall be filed with the Commission. (12) The Complainant bears the burden of proof, his failure to appear may result in the dismissal of his complaint. (13) The failure of the Defendant to appear may result in an Order granting the Complainant's requested relief. |
