Order Entered: (1) The Appendix to the Commission's Order of June 6, 2011 is deleted and Appendices A and B of this Order are substituted. (2) Ordering Paragraphs 3 through 6 of the Commission's Order of June 6, 2011 are amended to read: 3. No later than August 5, 2011, Coolbrook shall refund to its customers with interest all amounts collected for service rendered from February 16, 2011 through the date of this Order that are in excess of the rate set forth in appendix B to this Order. 4. Coolbrook shall pay interest on the refunded amounts at the average of the Three-Month Commercial Paper Rate as reported in the Federal Reserve Bulletin and the Federal Reserve Statistical Release on the date of this Order. 5. No later than August 19, 2011, Coolbrook shall submit a written report to the Commission in which it describes its efforts to refund all monies collected in excess of the rate that are set forth in Appendix B to this Order. 6. No later than June 27, 2011, Coolbrook shall file a revised tariff sheet with the Commission setting forth the rate approved in this Order.

Final Order Entered: (1) Coolbrook's proposed rates for sewer service are denied. (2) Coolbrook is authorized to assess a monthly fee of $30.15 for sewer service provided on and after February 16, 2011. (3) Within 60 days of the date of this Order, Coolbrook shall refund to its customers with interest all amounts collected for service rendered from February 16, 2011 through the date of this Order that are in excess of the rate set forth in this Order. (4) Coolbrook shall pay interest on the refunded amounts at the average of the Three-Month Commercial Paper Rate as reported in the Federal Reserve Bulletin and the Federal Reserve Statistical Release on the date of this Order. Refunds shall be based on each customer's usage while the proposed rates were in effect and shall be made as a one-time credit to the bills of current customers and by check to customers that have discontinued service since February 16, 2011. (5) Within 75 days of the date of this Order, Coolbrook shall submit a written report to the Commission in which it describes its efforts to refund all monies collected in excess of the rates that are set forth in the Appendix to this Order. (6) Within 20 days of the date of this Order, Coolbrook shall file a revised tariff sheet with the Commission setting forth the rates approved in this Order. Order Entered: (1) Coolbrook shall file with the Commission no later than April 1, 2011 any additional written comments regarding the findings contained in Commission Staff's report. (2) The Attorney General shall file with the Commission no later than April 11, 2011 his comments regarding the proposed rate adjustment contained in Commission Staff's report. (3) The parties shall notify the Commission in writing no later than April 18, 2011 whether this matter may be submitted for decision based upon the existing record and without hearing. (4) A formal hearing in this matter shall be held on April 26, 2011 at 10:00 a.m. in Hearing Room 1 of the Commission's offices. (5) Coolbrook shall publish notice of the hearing in accordance with 807 KAR 5:011, Section 8(5) and shall file with the Commission proof of publication no later than April 19, 2011. (6) Parties shall be limited in their opening statements at the hearing in this matter to five minutes or less. (7) Each party shall file with the Commission no later than April 21, 2011 a list of the persons it intends to call as witnesses. (8) Pursuant to KRS 2778.360, the record of the formal hearing in this matter shall be by videotape.

Order Entered: 1. All parties shall have 14 days from the date of this Order to file with the Commission written comments, if any, regarding the attached Staff Report and to request a hearing or an informal conference in this matter. 2. Any party requesting a hearing in this matter shall state in its request its objections to the findings set forth in the Staff Report and shall provide a brief summary of testimony that it would present at hearing. 3. A party’s failure to file with the Commission an objection to a finding or recommendation contained in the Staff Report within 14 days of the date of this Order shall be deemed as agreement with that finding or recommendation. 4. If no request for a hearing or an informal conference is received within the 14 days, this case shall stand submitted to the Commission for decision.

Order Entered: Coolbrook shall maintain its records in such manner as will allow it, the Commission, or any customer to determine the amounts to be refunded and to whom, in the event a refund is ordered upon final resolution of this matter.
