Order Entered: 1. The findings and recommendations contained in Commission Staffs report are adopted and incorporated by reference into this Order as if fully set out herein. 2. The rates set forth in the Appendix to this Order are approved for water service that Milburn District renders on and after the date of this Order. 3. Within 20 days of the date of this Order, Milburn District shall file a revised tariff sheet with the Commission setting forth the rates approved in this Order. 4. The informal conference and hearing scheduled in this matter are cancelled. 5. This matter is closed and shall be removed from the Commission’s docket.

Order Entered: (1) Milburn Water District's proposed rates are suspended from December 1, 2011 until April 30, 2012. (2) No later than February 1, 2012, Commission Staff shall file a written report containing its findings and recommendations. (3) The parties shall file their written comments on and any objections to the findings and recommendations no later than February 15, 2012. (4) A party’s failure to file written objections to a finding or recommendation by February 15, 2012, shall be deemed as agreement with that finding or recommendation. (5) No later than February 15, 2012, each party shall notify the Commission in writing whether this matter may be submitted for decision based upon the existing record without hearing. (6) Unless all parties request that this matter be submitted for decision upon the existing record, an informal conference shall be held on February 29, 2012 at 2:OO p.m., at the Commission’s offices . (7) Unless all parties request that this matter be submitted for decision upon the existing record, a formal hearing in this matter shall be held on March 14, 2012, beginning at 9:00 a.m. in Hearing Room 1 of the Commission’s offices. (8) Each party shall file no later than March 7, 2012, a list of witnesses. (9) Milburn Water District shall publish notice of the hearing no later than March 7, 2012. (10) The record on the formal hearing in this matter shall be by videotape. (11) Commission Staff shall make a written exhibit list.
