Final Order Entered: 1) KY Power is granted CPCN to construct Bonnyman-Soft Shell 138 kV transmission line & related facilities. 2) In the event KY Power moves centerline of right-of-way, KY Power shall provide evidence affected property owner, or owners, was notified in accordance with 807 KAR 5:120, Section 2(3). KY Power shall obtain written permission of property owner, or owners & provide copy of documentation within 30 days after documentation becomes available. 3) In the event Kentucky Power desire changes in route greater than distance identified, or involving landowners not identified in application, KY Power shall file new application. 4) In event another agency requires alteration of line that does not meet all of conditions identified in findings, Kentucky Power shall apply for CPCN for modified route. 5) Kentucky Power shall file any permits acquired within 30 days of issuance. 5) Before construction begins, Kentucky Power shall file survey of final location of transmission line, along with table of parcels and easement status demonstrating that Kentucky Power has obtained all necessary easements. If Kentucky Power has not obtained all of the easements necessary to construct the transmission line, KY Power shall file a report demonstrating that it has undertaken condemnation proceedings pursuant to KRS Chapter 416 in order to obtain necessary rights-of-way. 7) KY Power shall file “as-built” drawings or maps within 60 days of completion of construction.

Order Entered: (1) Pursuant to KRS 278.020(8), the period for review of Kentucky Power's application is extended 120 days from the September 29, 201 1 filing date, up to and including January 27, 2012. (2) The procedural schedule set forth in the Appendix to this Order shall be followed in this proceeding. (3) All requests for information and responses thereto shall be appropriately indexed and ten copies shall be filed with the Commission, with copies to all parties of record. Any request for information from the Commission Staff shall be responded to as if set forth in a Commission Order. All responses shall include the name of the witness who will be responsible for responding to questions related to the information provided. (4) Any party filing testimony shall file an original and ten copies. (5) Kentucky Power shall give notice of the hearing in accordance with the provisions set out in 807 KAR 501 1, Section 8(5). At the time publication is requested, Kentucky Power shall forward a duplicate of the notice and request to the Commission. (6) At any formal public hearing in this matter, neither opening statements nor summarization of direct testimony shall be permitted. (7) Nothing contained herein shall prevent the Commission from entering further Orders in this matter.
