Final Order Entered: (1) East Kentucky’s motion to withdraw the portion of its tariff proposing Section DSM-4, Dual Fuel Program, is granted. (2) East Kentucky’s tariff proposing Section DSM-5, Commercial & Industrial Advanced Lighting Program, and Section DSM-6, Industrial Compressed Air Program, is approved for service rendered on and after the date of this Order. (3) The tariffs filed by the 11 distribution cooperatives named in the findings above are approved for Section DSM-5, Commercial & Industrial Advanced Lighting Program, and Section DSM-6, Industrial Compressed Air Program, for service rendered on and after the date of this Order, and are denied as moot for Section DSM-4, Dual Fuel Program. (4) East Kentucky and the 11 distribution cooperatives named in the findings above shall file, within 20 days of the date of this Order, revised tariffs as approved herein reflecting their effective date and that they were approved pursuant to this Order. (5) Blue Grass, Farmers, Fleming-Mason, Salt River, and South Kentucky shall file, within 60 days of the date of this Order, either tariffs proposing Section DSM-5, Commercial & Industrial Advanced Lighting Program, and Section DSM-6, industrial Compressed Air Program, or cost benefit analyses supporting their respective decisions to not adopt the DSM programs.

Order Entered: (1) East Kentucky and its 16 distribution cooperatives shall be parties to this case. (2) The new DSM tariffs filed by East Kentucky, along with the corresponding new DSM tariffs filed by its 11 distribution cooperatives named in the above findings, are suspended for five months from their respective effective dates pursuant to KRS 278.1 90(2). (3) East Kentucky and each of its 16 distribution cooperatives shall file within 14 days of the date of this Order a written response to the questions set forth in the Appendix to this Order. (4) Any party that files a document with the Commission shall file an original and six copies, with copies to all parties of record. (5) All parties shall respond to any interrogatories or requests for production of documents submitted by Commission Staff. (6) 6. a. . Responses shall be appropriately bound, tabbed, indexed and shall include the name of the witness responding. b. Each response shall be answered under oath or be accompanied by a signed certification that the response is true and accurate to the best of that person’s knowledge, information, and belief formed after a reasonable inquiry. c. Any party shall make timely amendment to any prior response if it is now incorrect in any material respect. d. For any request to which a party fails or refuses to furnish all or part of requested information that party shall provide a written explanation of the specific grounds for its failure to completely and precisely respond.
