Order Entered: 1. Joint Petitioners' November 18, 2019 petition for confidential protection is granted. 2. The designated materials shall not be placed in the public record or made available for public inspection for an indefinite period, or until further Orders of this Commission. 3. Use of the designated materials in any Commission proceeding shall be in compliance with 807 KAR 5:001 , Section 13(9). 4. Joint Petitioners shall inform the Commission if the designated materials become publicly available or no longer qualifies for confidential treatment. 5. If a non-party to this proceeding requests to inspect the designated materials granted confidential protection by this Order and the period during which the materials have been granted confidential treatment has not expired, Joint Petitioners shall have 30 days from receipt of written notice of the request to demonstrate that the materials still fall within the exclusions from disclosure requirements established in KRS 61 .878. If Joint Petitioners are unable to make such demonstration, the requested materials shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. 6. The Commission shall not make the designated materials available for inspection for 30 days following an Order finding that the materials no longer qualify for confidential treatment in order to allow Joint Petitioners to seek a remedy afforded by law.

Order Entered: 1. Joint Petitioners' October 18, 2019 petition for confidential protection is granted in part and denied in part. 2. The designated materials contained in the Settlement Agreement related to the terms of BREC's settlement payment to LG&E and BREC's interconnection request are granted confidential protection and shall not be placed in the public record or made available for public inspection for an indefinite period, or until further Orders of this Commission. 3. The designated materials, contained in the Settlement Agreement related to the two territorial boundary maps, attached as Exhibits 1 and 2 to the Settlement Agreement, are denied confidential protection. 4. Use of the designated materials granted confidential protection by this Order in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 5. Joint Petitioners shall inform the Commission if the designated materials granted confidential protection by this Order become publicly available or no longer qualifies for confidential treatment. 6. If a non-party to this proceeding requests to inspect the designated materials granted confidential protection by this Order and the period during which the materials have been granted confidential treatment has not expired, Joint Petitioners shall have 30 days from receipt of written notice of the request to demonstrate that the materials still fall within the exclusions from disclosure requirements established in KRS 61.878.

Final Order Entered: 1 . The settlement agreement among the Joint Applicants regarding the provision of retail electric service in and around the Buttermilk Falls Industrial Park area as reflected in the revised Mauckport Quad map is approved. 2. All other certified territorial boundaries between Meade RECC and LG&E remain unchanged. 3. A copy of the revised Mauckport Quad, with the revisions signed by representatives of LG&E and Meade RECC on October 23, 2019, and October 24, 2019, respectively, attached as Exhibit 2 to the settlement agreement reflects the agreed-upon amended territorial boundary and the written agreement of LG&E and Meade RECC, and shall be attached to the Commission's official territory boundary map. 4. If Nucor fails to locate its proposed facility in the Buttermilk Falls Industrial Park area, no later than January 1, 2023, the Joint Applicants must notify the Commission that the settlement agreement is null and void, and that the Mauckport Quad in the area in and around Buttermilk Falls Industrial Park has returned to the 1982 provisions. 5. LG&E's request to establish a regulatory liability for the amounts associated with the payments in connection with the settlement agreement is approved. 6. The case is closed and removed from the Commission's docket.

Order Entered: 1. BREC and Meade County RECC's January 2, 2020 motion for confidential protection is granted. 2. The designated materials for which BREC and Meade County RECC seek confidential protection shall not be placed in the public record or made available for public inspection for an indefinite period or until further Order of this Commission. 3. Use of the material in question in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 4. BREC or Meade County RECC shall inform the Commission if the material in question becomes publicly available or no longer qualifies for confidential treatment. 5. If a non-party to this proceeding requests to inspect the material granted confidential treatment by this Order and the period during which the material has been granted confidential treatment has not expired, BREC and Meade County RECC shall have 30 days from receipt of written notice of the request to demonstrate that the material still falls within the exclusions from disclosure requirements established in KRS 61.878. If BREC or Meade County RECC is unable to make such demonstration, the requested material shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. 6. The Commission shall not make requested material available for inspection for 30 days following an Order finding material no longer qualifies for confidential treatment to allow BREC or Meade County RECC to seek remedy afforded by law.
