Order Entered: 1. Kentucky Power Company's August 12, 2019 motion to clarify and confirm the Commission's October 5, 2018 Order is granted. 2. Upon Kentucky Power's receipt and post-case filing of the industrial customer's assurance of financing, the CPCN conditionally granted by the October 5, 2018 Order shall become unconditional and the one-year time limit set forth in KRS 278.020(1) shall begin to run.

Final Order Entered: 1. Kentucky Power is conditionally granted a CPCN to construct and operate the Project as set forth in its application subject to reasonable assurance in writing from Braidy Industries that sufficient financing has been secured to complete construction of its planned facility. 2. The conditional CPCN granted in this Order shall become unconditional upon Kentucky Power's filing in the post-case correspondence file a copy of the written statement from Braidy Industries providing reasonable assurance that sufficient financing has been secured to complete construction of its planned facility. 3. Kentucky Power shall file a survey of the final location of the construction of the electric transmission line after any changes to the route authorized by the Order and before construction begins. 4. Kentucky Power shall file "as built" drawings or maps within 60 days of the completion of the construction of the electric transmission line and substation authorized by this Order. 5. In the event Kentucky Power moves the centerline of the right-of-way in either direction, Kentucky power shall provide evidence to the Commission that the affected property owner, or owners, onto whose property the line is moved, was notified of this proceeding in accordance with 807 KAR 5:120, Section 2(3).

Order Entered: 1. Kentucky Power's request for approval of the CPCN is continued for an additional 30 days, from September 25, 2018, to October 25, 2018, pursuant to KRS 278.020(8). 2. All parties shall adhere to the procedural schedule set forth in the Appendix to this Order. 3. a. Responses to requests for information in paper medium shall be appropriately bound, tabbed, and indexed and shall include the name of the witness responsible for responding to the questions related to the information provided, with an original in paper medium and an electronic version to the Commission. Electronic documents shall be in portable document format (PDF), shall be searchable, and shall be appropriately bookmarked. b. Each response shall be answered under oath or, for representatives of a public or private corporation or a partnership or association or a governmental agency, be accompanied by a signed certification of the preparer or person supervising the preparation of the response on behalf of the entity that the response is true and accurate to the best of that person's knowledge, information, and belief formed after a reasonable inquiry. c. Any party shall make timely amendment to any prior response if it obtains information which indicates that the response was incorrect when made or, though correct when made, is now incorrect in any material respect.
