Final Order Entered: 1. North Shelby is granted a CPCN for the proposed project as submitted. 2. North Shelby's proposed plan of financing is approved. 3. North Shelby is authorized to issue a Promissory Note in an amount not to exceed $1,998,000 to RD, maturing over a 40-year period, at an interest rate equal to the lower of the rate in effect at the time of loan approval, or the interest rate in effect at the time of closing, but not to exceed 2.375 percent per annum. 4. The proceeds from the note shall be used only for the purposes specified in North Shelby's application. 5. North Shelby shall obtain approval from the Commission prior to performing any additional construction not expressly authorized by this Order. 6. Notwithstanding ordering paragraphs 4 and 5, if surplus funds remain after the approved construction has been completed, North Shelby may use such surplus to construct additional plant facilities if RD approves of the use and the additional construction will not result in a change in North Shelby's rates for service. North Shelby shall provide written notice of this additional construction in accordance with 807 KAR 5:069, Section 4. 7. North Shelby shall file with the Commission documentation of the total costs of this project, including the cost of construction and all other capitalized costs, (e.g., engineering, legal, and administrative) within 60 days of the date that construction is substantially completed.

Order Entered: 1. All future correspondence or filings in connection with this case shall reference the above case number. 2. All documents submitted in this proceeding shall comply with the Commission’s rules of procedure as set forth in 807 KAR 5:001 and any deviation from these rules shall be submitted in writing to the Commission for consideration. 3. Any party filing a paper shall upload an electronic version using the Commission's E-Filing System and shall file an original and six copies in paper medium, except that only two copies in paper medium shall be filed of maps, plans, specifications, and drawings pursuant to 807 KAR 5:001, Section 15(2)(d). 4. Any request for confidential treatment of material submitted shall conform to the requirements in 807 KAR 5:001(13). 5. Materials submitted to the Commission which do not comply with the rules of procedure or that do not have an approved deviation are subject to rejection pursuant to 807 KAR 5:001, Section 3.
