Order Entered: 1. A hearing in this matter shall be held on Tuesday, September 1, 2020, at 9 a.m. Eastern Daylight Time, in the Richard Raff Hearing Room (Hearing Room 1) at the offices of the Public Service Commission at 211 Sower Boulevard, Frankfort, Kentucky, to take evidence regarding the transfer of assets from Southern Water and Sewer District (Southern District) to Prestonsburg City Utilities Commission (PCUC). 2. Southern District Board Chairman Jeff Prater shall appear in person at the September 1, 2020 hearing to provide testimony on behalf of Southern District. 3. PCUC Superintendent Brian Music shall appear in person at the September 1, 2020 hearing to provide testimony on behalf of PCUC. 4. Additional witnesses may be identified in a future Order to provide testimony regarding the transfer of assets. 5. Commission regulation 807 KAR 5:001, Section 22, provides that, upon showing of good cause, the Commission may permit deviations from its administrative regulations. The expedited nature of this hearing to take evidence on the issues of the asset transfer is good cause to deviate from the publication frequency requirements of 807 KAR 5:001, Section 9(2)(b). The Commission finds that Southern District should make a good faith effort to give notice of the hearing to the public, including publication by means of posting on a website or social media account.

Order Entered: 1. This proceeding is established to investigate the status of the transfer of certain wastewater and water system assets from Southern District to PCUC. 2. The records of Case Nos. 2017-00044, 2018-00230, and 2019-00131 are incorporated by reference into this proceeding. 3. Within 20 days of the date of entry of this Order, Southern District and PCUC shall jointly file with the Commission a copy of the most recent appraisal. 4. Within 20 days of the date of entry of this Order, Southern District shall file a response to the Order, setting forth the status of the transfer, the status of RD approval of the transaction, the status of sewer revenue due to PCUC by Southern District, and any changes of fact that may impact the transfer. 5.
