Order Entered: 1 . EKPC's motions for confidential protection for its responses to the requests for information contained in the Appendix to the Commission's Order dated August 12, 2016; its responses to Staff's First Request, Item 15; and its responses to Staff's Post Hearing Request, Item 5, are granted. 2. The designated materials shall not be placed in the public record or made available for public inspection for ten years, or until further Orders of this Commission. 3. Use of the designated materials in any Commission proceeding shall be in compliance with 807 KAR 5:001 , Section 13(9). 4. EKPC shall inform the Commission if the designated materials become publicly available or no longer qualify for confidential treatment. 5. If a non-party to this proceeding requests to inspect the designated materials granted confidential treatment by this Order and the period during which the materials have been granted confidential treatment has not expired, EKPC shall have 20 days from receipt of written notice of the request to demonstrate that the materials still fall within the exclusions from disclosure requirements established in KRS 61.878. If EKPC is unable to make such demonstration, the requested materials shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection.

Order Entered: 1. East Kentucky's request for rehearing is granted to the limited extent that our January 11, 2017 Final Order is clarified to state that when following the directive of PJM in response to a forced outage, East Kentucky's FAC shall reflect the PJM market price as the substitute cost of power. 2. This case is closed and is removed from the Commission's docket.

Final Order Entered: 1. The charges and credits billed by East Kentucky through its FAC for the period November 1, 2015, through April 30, 2016, are approved. 2. When East Kentucky uses its own generation to substitute for power during a forced outage, it shall immediately begin using the fuel costs associated with generating that power as the substitute cost of power rather than the price of market power.

Order Entered: 1. East Kentucky Power Cooperative, Inc. ("East Kentucky") shall appear in Hearing Room 1 of the Commission's offices at 211 Sower Boulevard, Frankfort, Kentucky, on November 9, 2016, at 9:00 a.m., Eastern Standard Time, to submit itself to examination on the application of its Fuel Adjustment Clause ("FAC") from November 1, 2015, through April 30, 2016. Neither opening statements nor summaries of pre-filed testimony will be permitted. 2. Not less than seven days and no more than 21 days prior to the scheduled hearing, East Kentucky shall publish in a newspaper of general circulation in each area in which it serves notice of the purpose, time, place, and date of the scheduled hearing. In addition, the notice of hearing shall include the following statement: "This hearing will be streamed live and may be viewed on the PSC website, psc.ky.gov." 3. East Kentucky shall file with the Commission no later than November 7, 2016, proof of publication of its notice for the hearing. 4. The official record of the proceeding shall be by video only.
